The 42-hour week: what employers should review

Team meeting in an office

The second stage of Law 21,561 took effect in April 2026. We review the points to check in contracts, shifts and internal regulations.

Law 21,561 gradually reduces the maximum ordinary working week from 45 to 40 hours. After the move to 44 hours in April 2024, the limit has been 42 hours since 26 April 2026, and it will reach 40 in April 2028.

What to review now

  • Contracts and addenda: agreed working hours must reflect the new maximum. Changes are best formalized through an addendum.
  • Shift distribution: the law allows several distribution formulas, including averaging systems in certain cases. Each has its own requirements.
  • Pay: the reduction in hours cannot result in lower pay.
  • Internal regulations: schedules, breaks and attendance controls must be updated.

An opportunity to get organized

More than a formality, the transition is a good time to review how work is organized and to prepare for the final 40-hour stage. An early assessment prevents issues in a Labor Board inspection.
